When you first contact us about your personal injury claim for compensation, and speak to one of our injury solicitors, we will assess whether or not you have a case.
The following lists what we require to make a case for compensation on your behalf:
- Details of what happened.
- The nature of your injury.
- Who was to blame or at fault?
- Proof that a person or organisation were negligent in some way, or mistreated you on unreasonable grounds.
The last point can be the hardest to obtain, but our injury lawyers will advise you on the best way to obtain proof to make your claim for compensation. It is always worth contacting us to see if you have a winnable case.
Our decision will be based on whether or not we feel we can win the case. We only get paid if we win and should we lose a case, not only do we not get paid, but the winning party may pursue you for their costs. For this reason we only take compensation cases we are confident we can win.
Pursuing a no win no fee claim for compensation
Should we decide there is sufficient proof available to take your case on a no win no fee basis, sometimes called a conditional fee arrangement, we will ask you to take out an insurance policy. The insurance policy protects you from being perused for court costs of the winning party should your claim for compensation be lost. Though the insurance policy costs between £2-900 and requires upfront payment, the policy is self underwritten so these costs will be reimbursed should the case be lost.
Once the details of your incident have been recorded and the injury claim started, the other party will be written to and compensation requested. Many realise that the claim cannot be refuted and subsequently settle out of court. If they feel there is a basis to fight the claim, then the case may well go to court.
Should the case go to court, our injury solicitors are skilled at fighting your case every step of the way, and though a court room can be quite a scary prospect, you will receive 100% support from our legal teams.
Should your case be successfully won we will not charge you a penny. Instead our fee comes from charging a success fee from the losing party, so the compensation you are awarded as a result of a successful claim is yours to keep.
What happens if I lose my case?
In the unlikely event that a case is lost, the insurance policy will cover any legal fees the winning party may pursue you for so you will not have to be a penny in legal fees. The beauty of the no win no fee or conditional arrangement, is that win or lose you pay no legal fees what so ever.
